Dak+ Terms and Conditions

These Terms and Conditions (the “Terms”) govern access to and use of Dak+, including all of its features, content, and related services.

By registering, accessing, or using Dak+, you agree to be bound by these Terms. If you do not agree with any of them, you must refrain from using the platform.

0. Definitions

For the purposes of these Terms, the following terms shall have the meanings set out below:

• “Dak+”, “DakPlus”, “the platform”, “we”, “us”, or “our”: refer to the Dak+ digital service and its operators.
• “User”: any person who accesses, browses, or uses Dak+, whether or not they have a registered account.
• “Dak Card”: the digital card created by a user within the platform.
• “Content”: any information, text, links, images, or other materials published by the user on their Dak Card.

1. Description of the service

Dak+ is a digital platform that allows individuals and businesses to create and share digital cards (“Dak Cards”) in order to centralize their online presence in a single link.

Users may include information such as name, biography, social media, contact methods, links, and other personalized content.

Dak+ may also offer additional features such as analytics, visibility tools, and advertising spaces within the platform.

2. User accounts

In order to use certain features, creating an account is required. The user agrees to provide truthful, current, and complete information during registration and to keep it updated.

The user is responsible for maintaining the confidentiality of their login credentials, as well as for all activities carried out under their account.

Dak+ shall not be liable for losses or damages resulting from unauthorized access when such access is caused by the user’s improper handling of their credentials.

3. User content

The user retains ownership of the content published on their Dak Card. However, by using the platform, the user grants Dak+ a non-exclusive, worldwide, royalty-free license to use, display, store, and distribute such content solely for the purpose of operating, improving, and promoting the platform.

The user is solely responsible for the content they publish, as well as for ensuring that such content does not violate any law or third-party rights.

4. Permitted use

The user agrees not to use Dak+ for unlawful, harmful, or abusive purposes. This includes, but is not limited to:

• Publishing illegal, fraudulent, or misleading content.
• Sharing content that infringes intellectual property rights.
• Distributing malware, spam, or malicious code.
• Attempting to access the platform or other users’ accounts without authorization.
• Using Dak+ to harass, abuse, or harm third parties.
• Publishing or promoting sexually explicit, pornographic, or inappropriate content for a general audience.

Dak+ reserves the right to remove content or restrict accounts that violate these conditions.

5. Public nature of Dak Cards

Dak Cards are designed to be public. Any person with access to the link may view the content that the user has decided to publish.

The user is responsible for the information they make public and should avoid sharing sensitive or confidential data.

6. Metrics and analytics

Dak+ may provide metrics such as visits, clicks, and other statistics related to the use of the card. These metrics are informational in nature and may not be completely accurate.

Dak+ reserves the right to modify, add, or remove analytics features at any time.

7. Advertising

Dak+ may display advertisements or promotional content within the platform, including within Dak Cards.

By using the service, the user accepts the inclusion of these elements as part of the platform’s operation.

Dak+ may modify the way advertising is displayed at any time.

8. Intellectual property

All elements of Dak+, including its design, brand, logo, code, and features, are the property of DakPlus or its licensors and are protected by applicable laws.

The reproduction, distribution, or unauthorized use of any part of the platform without prior written consent is prohibited.

9. Service availability

Dak+ strives to keep the platform available and operational, but does not guarantee that the service will be uninterrupted or error-free.

The platform may be suspended, modified, or interrupted temporarily or permanently, with or without prior notice, for technical, maintenance, or other reasons.

10. Suspension or cancellation of accounts

Dak+ reserves the right to suspend or cancel accounts that violate these Terms or that represent a risk to the platform or its users.

Likewise, it may remove or restrict content it considers inappropriate, illegal, or contrary to these conditions.

11. Limitation of liability

Dak+ is provided “as is” and “as available,” without warranties of any kind.

To the fullest extent permitted by law, Dak+ shall not be liable for indirect, incidental, or consequential damages arising from the use of the platform. This includes, among others, loss of data, loss of business opportunities, or service interruptions.

12. Third-party links

Dak Cards may contain links to third-party websites or services. Dak+ is not responsible for the content, availability, or practices of such external services.

The use of these services shall be at the sole responsibility of the user.

13. Modifications to the service

Dak+ reserves the right to modify, update, or remove features at any time. This may include the addition of new tools, changes in operation, or the removal of existing features.

14. Modifications to the Terms

Dak+ may update these Terms at any time. The updated version will be published on the platform with its corresponding date.

Continued use of the service after such changes implies acceptance of the new Terms.

15. Payments and monetization

Dak+ may offer paid features, services, or promotional spaces, including but not limited to advertising within the platform, increased visibility for Dak Cards, or other premium tools.

The user acknowledges and agrees that certain services may require the payment of fees, which will be communicated in due course within the platform or through Dak+’s official channels.

All payments made are final and non-refundable, unless expressly stated otherwise.

Dak+ reserves the right to modify, introduce, or remove fees at any time, as well as to change the conditions of paid services, with prior notice where applicable.

The user is responsible for providing valid payment information and for complying with any financial obligation arising from the use of paid services within the platform.

16. Governing law and jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the Dominican Republic.

Any controversy, claim, or dispute arising in connection with these Terms or with the use of Dak+, including their validity, interpretation, enforcement, or termination, shall be resolved exclusively before the competent courts of the Dominican Republic, and the parties waive any other jurisdiction that may otherwise apply to them.
